TERMS AND CONDITIONS
1.Who we are and what this covers
Guiltless Delights (Pty) Ltd sells gluten-free, Banting, keto, vegan, and vegetarian baked goods, ordered mostly through WhatsApp and our website. When you order from us, these Terms apply, along with our Refund Policy and Cancellation Policy. Please read all three — they work together.
If you're an individual buying for yourself, or a small business under the turnover threshold set by law, you count as a “consumer” and you keep all the protections the Consumer Protection Act gives you, no matter what these Terms say.
2. What we sell, and why our policies look different from a normal shop
Our products are baked fresh, to order, and they're perishable. That matters legally: the law treats made-to-order perishable food differently from something like a t-shirt or a kettle. In particular, the usual right to return something just because you changed your mind doesn't apply to fresh food made specifically for your order. We explain exactly what does apply in our Refund and Cancellation Policies — please read those before you order.
3. Placing an order
You order via WhatsApp or our website. Your order is only confirmed once we send you a clear confirmation showing what you're buying, the price, and the delivery details.
Check that confirmation carefully — items, quantities, address, and any dietary requirements — before you pay.
We can decline or adjust an order before confirming it, for example if something is out of stock or was priced incorrectly.
4. Prices and paying
All prices are in South African Rand and include VAT where we're required to charge it.
You can pay by PayFast (card, instant EFT, wallets) or manual bank transfer to our business account. Orders paid by manual transfer only go into production once we can see the payment or valid proof of payment.
If we ever list a price by mistake, we can correct it, and if needed cancel and refund the order, before we start baking it.
You'll get a proper tax invoice for every order.
5. Getting your order to you
We use a registered courier. Delivery estimates are our best guess, not a guarantee — things like courier delays, weather, or load-shedding are outside our control.
Because the food is perishable, please make sure someone can receive the delivery, and refrigerate or store it properly as soon as it arrives.
Once it's delivered to your address, it's your responsibility to look after it. Ownership passes to you once you've paid in full.
6. Ingredients, health, and allergens — please read this
We describe our products honestly, including what makes them gluten-free, Banting, keto, vegan, or vegetarian.
Our kitchen also handles gluten, dairy, nuts, and other allergens. We're careful, but we can't promise a product is completely free of trace allergens unless we've said so specifically and can back it up.
Anything we say about health or wellness — on WhatsApp, our website, or social media — is general information, not medical advice. If you have a medical condition, allergy, or are pregnant or breastfeeding, please check with a healthcare professional before relying on what we say about a product.
We're not claiming our products treat, cure, or prevent any illness.
7. Your personal information (POPIA)
We handle your personal information under the Protection of Personal Information Act (POPIA), and here's what that means in practice:
What we collect: your name, phone/WhatsApp number, delivery address, order history, and payment reference details. We never see or store your full card number — PayFast handles that directly.
Why we collect it: to take your order, deliver it, process payment, keep the tax records we're legally required to keep, and — only if you've said yes — to send you marketing messages.
You can withdraw marketing consent any time by replying “STOP” on WhatsApp or emailing us.
We only share what's necessary with PayFast (to take payment) and our courier (to deliver your order). We don't sell your information to anyone.
You can ask us what information we hold about you, ask us to correct it, or ask us to delete it, by contacting our Information Officer below.

9. If something goes wrong
We're not responsible for indirect losses, except where the law says we can't limit that (for example, if a product is genuinely unsafe and causes harm — that's always covered).
If a claim relates to a specific order, our responsibility for it is limited to the value of that order, except where the law doesn't allow limits at all.
10. If you have a complaint
Message us first on WhatsApp or email — most things can be sorted out directly.
If we can't resolve it, you can contact the National Consumer Commission (www.thencc.gov.za), or for privacy complaints, the Information Regulator.
These Terms are governed by South African law.
11. Changes to these Terms
We may update these Terms as our business or the law changes. The version live on our site at the time you order is the one that applies to that order.
